PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who are apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 498-A, 323, 406, 506(i) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act & Section 4 of Dowry Prohibition Act in Crime No.10 of 2018 on the file of the respondent police, seek anticipatory bail.
2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) appearing for the respondent police. 3.The petitioners undertake to hand over the jewels and certificates that are said to be with them to the defacto complainant. These shall be taken by the defacto complainant and the same shall be duly acknowledged. The petitioners further undertake https://hcservices.ecourts.gov.in/hcservices/
that a sum of Rs.6,000/- will be remitted in the bank account of the defacto complainant every month before 10th day. This liability shall commence from this month. This is only an interim arrangement. It does not foreclose the rights of the parties. 4.Recording the undertaking given by the petitioners, this Court is inclined to grant anticipatory bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Tenkasi and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation.
The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
