ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 32, 8(c), 20(b)(ii)(A) of NDPS Act and Section 77 of Juvenile Justice and Care and Protection Act, in Crime No.19 of 1/4

2026, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 11.01.2026, while the respondent police is on the patrol duty has found the petitioner along with other accused in possession of 10 grams of Kanja in the tank cover of the abondoned two wheeler. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is innocent and he was falsely implicated in this case and he is no way connected in the above said incident. He has not committed any offence as alleged by the prosecution. Hence, he prays to grant Anticipatory Bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submits that the offence is grave in nature. The petitioner along with other accused found in possession of 10 grams of Ganja. Though it was not a commercial quantity, the petitioner has 8 previous cases. Out of which 6 previous cases are similar in nature. He is a history sheeted. The FIR has been registered only on 11.01.2026. Investigation is in initial stage. Hence, he vehemently opposed the grant of anticipatory bail to the petitioners.

5.Heard the counsels on either side and perused the records. 6.Considering the rival submissions made on either side and considering the nature of allegation against the petitioner and though the quantity involved in this case is not a commercial quantity, as per the prosecution the petitioner has so many previous cases and he is a history sheeted person and the investigation is also in initial stage, this Court is declined to grant anticipatory bail to the petitioner.
