Prayer: Petition filed under Section 24 of Code of Civil Procedure to withdraw the case on the file of the Sub-Court, Devakottai, in H.M.O.P.No.178 of 2016 and transfer the same to the learned Subordinate Judge, Pudukkottai and pass further order orders as this Court may deem fit and proper.

JUDGMENT

The wife is before this Court seeking to transfer the H.M.O.P.No.178 of 2016 pending on the file of the Sub-Court, Devakottai, filed by the respondent/husband seeking of restitution of conjugal right to file of the Sub-Court, Pudukkottai.

2. Heard the learned Counsel appearing for the petitioner and the learned Counsel appearing for the respondent and perused the materials available on records.

3. Since the petitioner is living with her children in Gopalapuram Village, Piramanavayal P.O, Manamelkudi Taluk, Pudukkottai District, it may not be possible for a lady to travel from her native place to Devakottai.

4. Therefore, it is appropriate to transfer the H.M.O.P.No.178 of 2016 pending on the file of the Sub-Court, Devakottai to SubCourt Pudukkottai and accordingly, H.M.O.P.No.178 of 2016 on the file of the Sub-Court, Devakottai is transferred to the file of Sub-Court, Pudukkottai.
