PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to order in Refusal Number RFL/Nagamalai Pudukottai/11/2026 dated 01.04.2026 passed by the 3rd respondent and quash the same as illegal and direct the 3rd respondent to register the sale deed dated 30.03.2026.

The petitioner challenges the impugned refusal check slip dated 01.04.2026 issued by the third respondent.

2. The petitioner claims to be the owner of a residential property bearing Door No.5, Fenner Colony, Madurai Green City, Kochadai, Madurai, comprised in R.S. No.136/1, measuring an extent of 1937 sq.ft. The petitioner, intending to sell the said property, presented a sale deed for registration. However, the third respondent, on the instructions of the fourth respondent, refused to register the sale deed on the ground that an 2/6

FIR had been registered against the petitioner at the instance of the fifth respondent, alleging that certain amounts are due from the petitioner and accusing him of the offence of cheating.

3. Heard Mr. R. Ramadurai, learned counsel for the petitioner; Mr. F. Deepak, learned Special Government Pleader, who accepts notice on behalf of respondents 1 to 3; and Mr. M. Vaikkam Karunanithi, learned Government Advocate (Criminal Side), who accepts notice on behalf of the fourth respondent.

4. A Coordinate Bench of this Court, in identical circumstances, in W.P. No.12289 of 2020 (order dated 09.09.2020), held that refusal to register documents merely based on a communication from the police, in the absence of a valid order of attachment issued by a competent authority under the relevant statute, is arbitrary. It was further held that the registering authority cannot refuse registration of a document solely on the basis of such police communication.

In light of the above, the writ petition is allowed and the impugned refusal check slip issued by the third respondent in Refusal No. RFL/Nagamalai Pudukottai/11/2026 dated 01.04.2026 is hereby quashed. The third respondent is directed to register the sale deed dated 30.03.2026 presented by the petitioner, subject to the petitioner satisfying all other statutory requirements.

6. The aforesaid exercise shall be completed within a period of one

(1) month from the date of receipt of a copy of this order.

7. There shall be no order as to costs.
