JUDGMENT

Heard both sides.

2.The appellant was the President of a cooperative society. He suffered surcharge order. The appellant had also filed C.M.A.(CS) No.10 of 2025 before the Principal District Court, Thoothukudi. In the meanwhile, the properties of the appellant have been brought to sale. Challenging the auction notice dated 17.03.2025, the appellant filed W.P.(MD)No.8849 of 2025. The learned Single Judge closed the writ petition by granting liberty to the appellant to approach the appellate Court and obtain interim order.

3.We are of the view that the approach adopted by the learned Single Judge does not call for interference. If the appellant files any 2/4

interim application in the pending C.M.A.(CS) No.10 of 2025, it shall be numbered immediately and disposed of as expeditiously as possible. The writ appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
