Mr.B.Arun, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.215 of 2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent Police for the offence punishable under Section 67A of the Information Technology Act 2000, in Crime No.215 of 2021, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant's photo along with her husband's photo has been published in YouTube channel by the accused and her conversation with one Selva has also been published with obscene title, due to which, she is separated from her husband. Further, the obscene pictures of the defacto complainant has been published in YouTube chaneels, such as, Madurai Selva, Suganthi Official and Balabala, which defamed the defacto complainant and put her into mental agony and instigated her to attempt suicide.

3. The learned counsel for the petitioner submits that the petitioner is also a victim and she has not committed any offence as alleged by the prosecution and she was also abused by the defacto complainant.

4. Whereas the defacto complainant has placed some materials before this Court, which show the manner in which the defacto complainant was abused.

5. This Court perused the materials placed before this Court.

6. It is unfortunate, how the people are misusing the social media to tarnish the image of certain individuals. The petitioner was taking advantage of the social media to tarnish the image of the defacto complainant by abusive words.

7. Considering the manner in which the social media has been misused by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and this petition is dismissed.
