ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191 (2), 192(3), 296(b), 115(2), 118(1), 109(1) BNS @ Sections 191(2), 192(3), 296(b), 103(2) BNS, in Crime No.91 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to money dispute, on 17.02.2026 the petitioner along with other accused persons have abused the deceased/Rameshkannan in filthy language and attacked with deadly weapons and caused injuries and hence, the deceased was admitted in Government Hospital, Dindigul and subsequently shifted to Government Rajaji Hospital, Madurai. Due to grievous injuries, the deceased died on 23.02.2026. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that co-accused in this case already granted bail. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor opposed for grant of anticipatory bail to the petitioner on the ground that the petitioner attacked the deceased with wooden log and there is a specific overt act against the petitioner.

5. Considering the facts and circumstances of the case and considering the overt act against the petitioner and the fact that it is a case of murder, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 06.05.2026 LS TO 1.The Inspector of Police, Batlagundu, Police Station, Dindigul District.
