ORDER

This writ petition has been filed seeking a direction to the respondents to permit the petitioners to continue their B.Com degree course in the respondent college and to permit them to write the semester examination both Practical and Theory examination commencing from 23.04.2025, in consideration of their representation dated 16.04.2025, forthwith.

2. Considering the nature of the order going to be passed in this writ petition, notice to the respondents is dispensed with and this writ petition is disposed at the stage of admission itself.

3. The petitioners are the students studying B.Com., in the respondent College and they have been implicated in a case registered under the NDPS Act, in Crime No.122 of 2025 dated 19.03.2025. Though the petitioners in the said case have already been granted bail by the jurisdictional Sessions Court, they are not permitted to appear for the semester examinations by the respondent college. Hence, the present Writ Petition. 2/6

4. On perusal of the case, it is seen that the petitioners are the students pursuing B.Com Course in the first respondent college and a case was registered against them under NDPS Act. It is pertinent to note that the petitioners are not the habitual offenders and it also seems that this case alone was registered against them.

5. Considering the facts and circumstances of the case and also taking into account, the future career of the petitioners, this Court taking a lenient view directs the first respondent to permit the petitioners to pursue their studies and also to write the semester examination both practical and theory examination as prayed by them, without any hindrance. But however, there is no impediment for the authorities concerned to proceed with the trial proceedings in the said case registered against the petitioners and it is the first respondent college to take further action, subject to the outcome of the criminal case. It is also made clear that the petitioners shall not indulge in any other illegal activities in and outside the college, failing which, the first respondent is at liberty to take action in accordance with law. 3/6

6. With the above observations and directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
