: Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent herein to issue the New Passport in favour of the petitioner, on the basis of his application dated 27.08.2020, within the time stipulated by this Court.

O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the Second respondent.

2.The petitioner seeks issuance of new passport based on the petition mentioned application.

3.When the matter was taken up for hearing, the learned Additional Government Pleader informs the Court that the criminal case registered against the petitioner culminated in a charge sheet and the same was also taken on file in CC No.24 of 2016 on the file of Judicial Magistrate Court No.II, Kulithurai. Therefore, the petitioner has to necessarily move the Court below for relief. https://hcservices.ecourts.gov.in/hcservices/

W.P.(MD)No.11898 of 2020 4.The petitioner's counsel informs the Court that the petitioner would move the Court below within a period of two weeks from the date of receipt of a copy of this order. The Court below shall dispose of the petitioner's application regarding the request of his passport, on merits and in accordance with law, within a period of three weeks thereafter.I make it clear that I have not gone into the merits of the matter.

5.With the aforesaid direction, the Writ Petition is disposed of. No costs.
