PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C COMMON ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with the cases in Crime Nos.118 and 119 of 2024, for the offence punishable under Sections 24(1) of Cigarette and other Tobacco Products Act 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015, has filed these petitions seeking anticipatory bail. 2.The case of the prosecution for Crl.O.P(MD)No.7251 of 2024 is that the petitioner and others were found illegally selling banned tobacco products and the respondent police have also seized fifty one packets of Ganesh Tobacoo and seventen packets of Cool Lip from the accused persons. Hence the case. 3.The case of the prosecution for Crl.O.P(MD)No.
7335 of 2024 is that the petitioner and others were found illegally selling banned tobacco products and the respondent police have also seized twenty five packets of Cool Lip and fifty two packets of banned pan masala from the accused persons. Hence the case. 4.
an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner. 5.The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that earlier, this Court, by order dated 05.06.2024, has granted interim anticipatory bail to the petitioner with a direction to co-operate for the investigation. However, the petitioner has not appeared before the respondent police as directed by this Court.
6. Considering the conduct of the petitioner, this Court is not inclined to grant any relief to the petitioner. Accordingly, these Criminal Original Petitions are dismissed.
