For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1057 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 448, 294(b) and 506(ii) of IPC, in Crime No.1057 of 2020, seeks anticipatory bail.
2.The case of the prosecution is that The defacto complainant is an advocate. On 29.12.2020 at about 9.00 pm., when he was in his house, the accused criminally trespassed into the house of the defacto complainant, scolded him in filthy language . When he came out of the house the petitioner herein tried to attack him with iron rod. Fearing his life the defacto complainant closed the door and went inside. CRL OP(MD). No.9542 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) for the respondent strongly opposed this petition on the ground that investigation is pending. He would also submit that one previous case is pending against the petitioner in Crime No. 504 of 2021.
5. It is seen from the facts of the case the defacto complainant is an advocate and he was criminally intimidated by the petitioner.
6. Taking note of the fact that one previous case is pending against the petitioner,this Court is not inclined to grant bail to the petitioner.
