This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the first respondent to issue fresh passport to the petitioner on the basis of the application given by petitioner in application No.MD01C5033642921, dated 14.09.2021. 2.Heard Mr.S.Sarvagan Prabhu, learned Counsel for the petitioner, Mr.K.Govindarajan, learned Deputy Solicitor General of India for the first respondent and Mr.N.Muthu Vijayan, learned Additional Government Pleader for the second respondent. 3.The petitioner was issued with a notice by the first respondent, wherein, it was informed that an FIR in Cr.No.659 of 2012 had been registered against the petitioner under Sections 294(b), 323, 324 and 506(ii) IPC by the second respondent herein.

4.A status report was called for from the second respondent and it is today informed by the learned Special Government Pleader that consequent to investigation, final report had been filed on 10.01.2013 before the learned Judicial Magistrate-I, Dindigul and taken cognizance on 21.06.2023 as C.C.No.376 of 2023.
5.Since the matter is pending consideration of the competent jurisdictional Magistrate Court, it would only be appropriate that the petitioner approaches the said Court/Judicial Magistrate-I, Dindigul and obtains necessary permission for processing the application of the petitioner seeking passport. In the Writ Petition, the said relief cannot be granted, but since a direction is given, the Writ Petition stands disposed of. No costs.
