ORDER

This writ petition has been filed for the issue of a writ of Mandamus, directing the fourth respondent to consider the representation made by the petitioner, on 05.03.2018, wherein, the petitioner is seeking for the issuance of patta in his name with respect to the subject property.

2.The case of the petitioner is that he is the owner of the subject property by virtue of a registered sale deed, dated 10.06.2014. The further case of the petitioner is that the subject property was subdivided at the time when the natham scheme was 1/3

undertaken and the classification was changed from punja to natham and it was subdivided into four survey numbers. The petitioner had purchased the subdivided property in S.No.112/10A4 measuring an extent of 07390 sq. meters.

3.The petitioner had made an application for issuance of patta with respect to the subject property, in favour of him. Immediately, on receipt of the application, the third respondent through letter, dated 13.03.2018, directed the fourth respondent to consider the application. The further case of the petitioner is that the Village Administrative Officer was also directed to give a report in this regard and the Village Administrative Officer is also said to have submitted the report. The grievance of the petitioner is that all the reports have been submitted as early as in January 2020 itself and in spite of the same, the patta has not been issued in favour of the petitioner. Left with no other option, the present writ petition has been filed.

4.Heard Mr.P.Ganapathi Subramanian, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondents.

5.Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the fourth respondent to take a final decision on the application submitted by the petitioner and pass orders on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 6.The petitioner is directed to make a fresh representation to the fourth respondent, along with all relevant documents and also a copy of this order.

7.This writ petition is disposed of with the above direction. No costs.
