Heard the learned counsel on either side.
2.The second respondent had issued the impugned demand calling upon the petitioner to pay a sum of Rs.9,84,181/-. The said amount represents the arrears payable in respect of the petition mentioned service connection. The stand of the petitioner is that the service connection is that of her vendor and that the petitioner was not using the said service connection and she is https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)No.11533 of 2022 having an independent service connection. The learned standing counsel would point out that after purchase from the previous vendor in the year 2018, the petitioner was very much using the petition mentioned service connection till 2020. Therefore, according to the learned standing counsel, the said amount represents only the consumption charges of the writ petitioner herself.
3.However, taking note of the special facts and circumstances obtaining in this case, the petitioner is permitted to clear the said liability in six equal monthly installments. The first installment shall commence on 21.06.2022. On payment of first installment, the new service connection standing in the name of the petitioner will be restored.
4.The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
