Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the respondents 2, 4 and 5 to consider the petitioner's representation dated 15.05.2024 and to provide police protection for conducting chariot procession from Ervadi Thanneer Panthal to Ervadi Dargha by the Muthirayar community people of Ervadi Village on 19.05.2024 in the event of Santhanakoodu Urus festival at Ervadi Village, Ramanathapuram District.

ORDER
The present Writ Petition is filed for Mandamus seeking police protection for conducting chariot procession from Ervadi Thanneer Panthal to Ervadi Dargha by the Muthirayar community by considering the representation dated 15.05.2024. The said function is scheduled to be conducted on 19.05.2024. Hence, the present Writ Petition is moved on 19.05.2024.
2. Mr.R.Suresh Kumar, learned Government Advocate (Crl. Side), takes notice for the respondents.

The learned counsel appearing for the petitioner submitted that in the year 2019, a peace committee meeting was conducted among the Muthirayar community, Yadhava community and other community as well. The Konar community claims that they have the right to carry the flag in the chariot. Now, the Muthirayar community is also claiming rights to carry the same flag in the said chariot. In the year 2019, the peace committee meeting was conducted and it was decided that the Konar community shall carry the flag from Thaikka to Thanneer Panthal and the Muthirayar community from Thanneer Panthal to Dargha. The learned counsel for the petitioner submitted that the same shall be granted to the Muthirayar community this year also. But, the respondents are refusing to grant any permission.
4. Since the Konar community is objecting, in order to resolve the same, a peace committee meeting for the year 2024 was also conducted. But the Konar community refused to accept any proposal and they left the peace committee meeting abruptly.
5. However, a positive direction cannot be granted since the Konar community is not added as a party in the present Writ Petition. Therefore, this Court is of the considered opinion that the representation of the petitioner shall be considered by taking all the factors into consideration, especially, the peace committee meeting conducted in the year 2019 and 2023. Therefore, the second respondent is directed to consider the petitioner's representation dated 15.05.2024 and pass appropriate orders in consultation with the respondents 4 and 5, in the light of the peace committee meeting dated 20.07.2019 and 05.06.2023.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed. Since the procession is scheduled to be conducted today (19.05.2024), order shall be issued through web copy and through mail.
