PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., directing the second respondent not to interfere in put up the superstructure by the third respondent in S.F.Nos.377/6, 378/1B, 379/2A, 381/6, 381/7, 384/4C, 386/3A, 386/3C, 386/3F, 386/7, 391/3, 391/4C, 391/4D, 391/4E, 391/7, 384/2, 386/3B, 386/3E & 391/4A, situated in Keelapaguthi Village, Tharagampatti, Kulitalai Taluk, Karur District.

For Petitioner : Mr.J.Sivaram For R1 & R2 : Mr.R.M.Anbunithi Additional Public Prosecutor.

ORDER

This petition has been filed to direct the second respondent not to interfere in put up the superstructure by the third respondent in S.F.Nos.377/6, 378/1B, 379/2A, 381/6, 381/7, 384/4C, 386/3A, 386/3C, 386/3F, 386/7, 391/3, 391/4C, 391/4D, 391/4E, 391/7, 384/2, 386/3B, 386/3E & 391/4A, situated in Keelapaguthi Village, tharagampatti, Kulitalai Taluk, Karur District.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor(Crl.side) for the respondents 1 & 2.

3.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that no complaint has been received either from the petitioner or from the third respondent.

4. On perusal of records, it is seen that the petitioner enclosed a copy of the representation even without signature. No postal receipt is also submitted.

Crl.O.P(MD).No.9631 of 2021 5.Recording the submission of the learned Additional Public Prosecutor that no complaint has been received and also considering the fact that there is no proper representation given by the petitioner, this Criminal Original Petition is dismissed. The petitioner is at liberty to submit a fresh representation with signature and also file a fresh application, if any necessary arises.
