PRAYER :- To release the petitioner on bail in connection with Crime No.444 of 2022 pending on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested on 26.04.2024 in connection with the alleged offence under Section 394 of IPC @ Sections 27(2) of Arms Act and 20(b)(ii)(A) 1/3

and 8(c) of NDPS Act in Crime No.444 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 21.12.2022, the petitioner and A2 threatened the defacto complainant by showing a weapon and also attempted to rob the gold chains. Hence, the case.

3.The learned counsel for the petitioner submits that the petitioner is an innocent and he has been falsely implicated in this case. 4.The learned Additional Public Prosecutor has raised serious objections that the petitioner has involved in 17 previous cases to his credit and he was also found in possession of 700 grams of Ganja illegally. He further submits that the investigation has been completed and the charge sheet has already been filed before the Principal District and Sessions Judge, Virudhunagar District at Srivilliputtur and the same is taken on file in S.C.No.45 of 2023 and the trial has commenced and L.W.1 and L.W.2 have already been examined and the case is posted for examination of other witnesses.

5.Though the petitioner has been convinced that the contraband involved is only 700 grams of Ganja and considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed with a direction to 2/3

the learned Principal District and Sessions Judge, Virudhunagar District at Srivilliputtur to conclude the trial and dispose of the case in S.C.No.45 of 2023 as expeditiously as possible.
