Heard both sides.

2. Even though relief has been sought in respect of two survey numbers, the learned Special Government Pleader clarifies that survey No.606/2 alone has been classified as water body. The said water body vests with Public Works Department.

3. The jurisdictional Tahsildar is directed to conduct survey, 2/5

3 W.P.(MD)NO.10045 OF 2026 and issue a Form-I notice. Based on the same, the competent authority(the third respondent herein) shall take consequential action to remove the encroachments in question. The procedures set out in the statute shall be followed. All the encroachers shall be given due opportunity to place their case. Once the competent authority confirms that there are encroachments, the same will be removed. The entire exercise will be completed within a period of four months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
