PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.67 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/A.1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 392 and 506(2) IPC, in Crime No.67 of 2022, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and other accused abused the defacto complainant and snatched 2 sovereign of gold chain from him. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that property is not yet recovered. He would further submit that the petitioner is having one previous case for similar offence.
5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the facts that property is not yet recovered, that the other accused 2 and 3 are still https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.10409 of 2022 absconding and that the petitioner is having a previous case for similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.
