Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 3 to grant permission to conduct the festival of Sri Periya Kaliyamman Kovil situated at Nilakottai Taluk, Dindigul District to be scheduled on 14.06.2022 to 16.06.2022 by considering representation dated 14.05.2022 .

O R D E R

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for R1 to R3. Thiru.M.Sundaraj Naidu/fourth respondent is present before this Court in person. Thiru.Govindaraj, SSI of Police, Nilakkottai Police Station is also present before this Court.

2. Mr.M.Sundaraj categorically stated that he had nothing to do with the dispute and that he has been wrongly impleaded as a party in the proceedings.

3. It appears that there is a dispute between the two groups in the Chettiyar Community regarding offering worship in the petition mentioned temple.One group is led by Thiru.Kalidoss, while the other group is led by Thiru.Ramamoorthy. The group led by Kalidoss have https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.11791 of 2022 already offered their worship. As per the decision taken in the Peace Committee Meeting, the group led by Ramamoorthy have to conduct the festival for the temple from today till 16.06.2022. Since the other group has already celebrated the festival, no exception can be taken to the petitioner's request.

4. The Special Sub-Inspector of Police, Nilakottai Police Station, is directed to ensure that the petitioner's group peacefully celebrates the petition mentioned festival from today till 16.06.2022. Regarding the conduct of the festival from the next year onwards, if differences still persist, the parties will have to necessarily work out their rights only before the jurisdictional civil Court. I make it clear that writ petitions will no more be entertained at the instance of the petitioner herein.

5. Thiru.M.Sundaraj Naidu fairly states that even though he has been vexed, this Court may take a lenient view and close the matter. I appreciate the fair gesture and the stand taken by the fourth respondent.

6. This Writ Petition is allowed with the aforesaid direction. No cost.
