RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honourable Court in Crl.O.P(MD)No.7164 of 2020 dated 26/11/2020 in Crime.No.458 of 2020 pending on the file of the Respondent Police and allow the petitioner to return the money in terms of document for sum of Rs.3,00,000/-.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.PRABHA, Advocate for the petitioner and of Mr.M.MUTHUMANIKKAM, Government Advocate(Crl.side), on behalf of the Respondent the court made the following order:- The petition has been filed to modify the condition imposed by this Court in Crl.O.P(MD)No.7164 of 2020 dated 26.11.2020.

2. The learned counsel appearing for the petitioner would submit that the petitioner was granted anticipatory bail by this Court on 26.11.2020 with a condition to deposit a sum of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.4971 of 2021 Rs.3,00,000/- to the credit of CrimeNo.438 of 2020 with a period of four weeks before the concerned Court. He would further submit that the petitioner is unable to mobilize the said amount, hence he seeks modification of the said condition.

3. This is a case of job racketing and cheating the defacto complainant and others to the tune of Rs. 7,50,000/- on the false promise of getting job in the High Court.

4. This condition was imposed taking into consideration the nature and serious offence and the monetary loss caused to the victims, hence this Court is not inclined to modify the condition.
