Mr.G.Thalaimutharasu, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.176 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner is facing charges under Section 381 IPC in Crime No.176 of 2022 on the file of the respondent police. 2.The case of the prosecution is that the defacto complainant lodged a complaint stating that on 09.03.2022, he along with his wife went to the hospital for scanning purpose. They returned to the house at about 02.00 pm., and again they went to the hospital and returned back to the house at about 08.30 pm. At that time, when the wife has checked the jewels, they were found missing. Suspecting the involvement of this petitioner, the defacto complainant made a complaint stating that the jewels worth about Rs.4,50,000/- found missing. Based upon the CCTV footage, the case has been registered against this petitioner.

CRL OP(MD). No.10432 of 2022 3.Seeking anticipatory bail, this petition has been filed by this petitioner stating that he has not involved in the aforesaid occurrence. He was working in the defacto complainant's house for many years.

4.However, from the CCTV footage, it is seen that prima facie ground is available to proceed the case against the petitioner. The petitioner has to surrender before the respondent police and cooperate with him to complete the process of investigation by subjecting herself to custodial interrogation, since the jewels that have been stolen have not been recovered so far. 5.With the aforesaid direction, this petition is dismissed.
