ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 I.P.C, r/w Section 21 (1) Mines and Minerals (Development and Regulations) Act, 1957 in Crime No.8 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 11.01.2022, without any valid permission, the 1st accused illegally transported 1 unit of river sand. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and simply because she is the owner of the vehicle, which was involved in the aforesaid occurrence, she https://hcservices.ecourts.gov.in/hcservices/
has been falsely implicated in the case. On the previous occasion, the three petitions, which have been filed by the petitioner herein seeking anticipatory bail, have been dismissed by this Court on the ground that the petitioner is having one similar case. 4.Perusal of records shows that even after a lapse of several months, no attempt has been made by the respondent police to arrest the petitioner. But, those things cannot be considered by this Court at this stage. The only ground, which can be considered by this Court, is the previous antecedents of the petitioner. But, considering the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to her. This petition deserves to be dismissed and accordingly, dismissed.
