For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.19 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused No.3,4&5, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 447, 427, 294(b) and 506(ii) I.P.C, in Crime No.19 of 2022 on the file of the respondent police, seek anticipatory bail.

2.This second anticipatory bail petition has been moved on the ground that earlier anticipatory bail petition was moved by the petitioners in Crl.MP.No.1816 of 2022 was allowed by the learned Principal Sessions Judge, Theni, by the order dated 28.04.2022 on conditions. But, the petitioners could not execute the sureties within a time. So, automatically it lapsed.

3.It is seen that the Trial Court already granted anticipatory bail to the petitioners. Since they are not in a position to arrange sureties, they could not execute the same within a stipulated time. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.12389 of 2022 4.It is also seen from the records that the petitioners have filed a petition seeking extension of time before the Trial Court and that was returned by the order, dated 27.06.2022. 5.The learned Sessions Judge, Theni, is directed to take the above said petition on file and decide the same on merit. 6.With the above direction, this Criminal Original Petition is disposed of.
