O R D E R

Heard the learned counsel on either side.

2. The petitioner seeks cancellation of patta that is standing in the name of the fourth respondent.

3. The third respondent has no role in the matter. The first respondent shall take action on merits and in accordance with law. The petitioner is permitted to file a fresh appeal before the first respondent. The first respondent shall issue notice to the fourth respondent and other interested parties, if any. After holding a proper enquiry and getting report from the second respondent, final order shall be passed. Such an order will be passed within a period of twelve weeks after receipt of the appeal petition from the petitioner. I make it clear that the I have not gone into the merits of the matter. It is open to the first respondent to pass order one way or the other.
