2. The learned Additional Public Prosecutor would submit that enquiry was undertaken in CSR No.337 of 2022. During the course of enquiry, both side parties appeared and the petitioner also gave a statement that he filed a Writ Petition in W.P(MD) No.22243 of 2021 against the third party, which is also pending before this Court. Later, he gave statement undertaking that the property if measured and they will not make trouble. On the basis of the above said undertaking and understanding, the complaint given by the petitioner was also closed. Apart from that, the parties also undertook to abide by the order that is passed by this Court in W.P(MD) No.22243 of 2021.

3. In view of the above said undertaking and understanding, 2/4
