PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :-For Bail in Crime No.158 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A8, who was arrested on 16.03.2021 for the offences punishable under Sections 294(b), 341,324,307,506(ii) and 120(B) of IPC in Crime No.158 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that there is a previous dispute between the family of the defacto complainant and family of Muthuramalingam in connection with election. On 16.06.2021 at about 9.00 pm., when the defacto complainant husband was going in front of JJ Chamber, Saravanan and his father Karmegam and two more persons waylaid him, scolded him in filthy language and attacked him with aruval, as a result he suffered injuries on his head, left hand, right hand and chest. Therefore the case came to be registered. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 16.03.2021, hence he seeks bail. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Additional Public Prosecutor appearing for the respondent opposed the bail petition on the ground that the investigation is not yet completed. He would further submit that three previous case is pending against the petitioner in Crime Nos.254 of 2017,258 of 17 and 153 of 21 on the file of the Nainarkovil Police Station.

5. Considering the nature of offence and the fact that the petitioner is having three previous case pending against him, this Court is not inclined to grant bail to the petitioner.
