PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the Court of the learned Judicial Magistrate, Additional Mahila Court, Nagercoil, to consider and allow the copy application in CA.No.218/2026 in CC.No.227/2025 by furnishing certified copy of the CCTV footage to the petitioner within a time frame to be fixed by this Court. 1/4

ORDER
The present petition has been filed by the defacto complainant seeking a direction to the learned Judicial Magistrate, Additional Mahila Court, Nagercoil, to consider and allow a copy application in C.A.No.218 of 2026 in C.C.No.227 of 2025, by furnishing certified copy of CCTV footage to the petitioner.
2. According to the learned Counsel appearing for the petitioner, though CCTV footage is enclosed along with the charge sheet, when the copy application was filed, the same was returned on the ground that certified copy of the CCTV footage cannot be given to the petitioner.
3. The learned Counsel for State of TN(crl.side) appearing for the first respondent police submitted that along with the charge sheet, CCTV footage has been enclosed as the 5th document and therefore, as and when the copy application is presented by the petitioner to the concerned Court, the prosecution has no objection whatsoever for furnishing a copy of the CCTV 2/4
footage to the petitioner. He further submitted that the corrected list of documents have already been filed before the concerned trial Court.

Considering the above said facts, the learned Judicial Magistrate, Additional Mahila Court, Nagercoil, is directed to consider the copy application in C.A.No.218 of 2026 in C.C.No.227 of 2025 and provide a copy of CCTV footage which has been marked as the 5th document along with the charge sheet.
5. With the above said observations, the Criminal Original Petition stands allowed.
