Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to implement the order passed by the Tribunal dated 28.11.2023 vide Mu.Mu.No.2690/2023/A2 in the real letter and spirit and to declare the settlement deed executed in favour of the said S.Thirumoolam dated 22.06.2009 vide Document No.2109/2009 as null and void and to evict him from the property and to ensure the petitioner's 1/6
life and property and allow the petitioner to live with security and dignity on the basis of the petitioner's representation dated 09.12.2025 in accordance with law within the time stipulated by this Court. ORDER
The petitioner is before this Court seeking for a direction to the respondents 1 and 2 to implement the order passed by the Tribunal dated 28.11.2023.
2. In the order passed by the second respondent/Tribunal, the petitioner's son namely, S.Ramesh was directed not to disturb the possession of the subject property. The said order has been upheld by the first respondent as well by this Court. The petitioner submitted a representation to the respondents 1 and 2 to implement the order by taking action against the petitioner's another son namely, Thirumoolam. 2/6
3. The petitioner's grievance is that the respondents 1 and 2 have not acted upon the said representation to implement the order passed by the second respondent.
4. Learned State counsel on receiving instructions submitted that appropriate action will be taken against the said Thirumoolam in terms of the order passed by the first respondent within the time stipulated by this Court.
5.The said submission is taken on record.
6. This Writ Petition is disposed of directing the respondents 1 and 2 to implement the order passed by the second respondent bearing Mu.Mu.No.2690/2023/A2 dated 28.11.2023 in accordance with law.
7. The said exercise shall be completed within a period of one month from the date of receipt of a copy of this order . 3/6
8. There shall be no orders as to costs.
