Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the 3rd respondent to issue Electricity service connection to the Kannimar Temple situated at Dindigul District, Reddiar Chadiram, Silvarpatti bearing Survey No.632/8 having an extent of 0.07.5 ares in the light of the petitioner's representation dated 15/05/2017 to the 3rd respondent.

ORDER

The petitioner has come forward with the present Writ Petition seeking direction to the 3rd respondent to issue electricity service connection to the Kannimar Temple situated at Dindigul District, Reddiar Chadiram, Silvarpatti, bearing Survey No.632/8, having an extent of 0.07.5 ares, in the light of the petitioner's representation dated 15.05.2017.

2.The petitioner applied for electricity service connection to Kannimar Temple situated at Dindigul District, Reddiar Chadiram, Silvarpatti, bearing Survey No.632/8 on 15.05.2017. Rule 27 (12) of https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.14585 of 2019 the Tamil Nadu Electricity Distribution Code, 2004, specifies as under:

"27.Requisitions for supply of energy.

**** (12)Supply shall be given to poramboke lands/Government lands on production of No Objection Certificate obtained from the concerned officer of the Government of Tamil Nadu. The applicant shall execute an indemnity bond in Form 6 of the Annexure III to this Code and also pay security deposit twice the normal rate." 3.According to the petitioner, he obtained No Objection Certificate and submitted the same to the respondents and inspite of the same, the respondents have not provided electricity service connection.

4.A perusal of the records shows that the Zonal Deputy Tahsidar, Dindigul West Taluk has issued certificate for procuring electricity service connection. Under such circumstances, the third respondent should provide electricity service connection to the petitioner.

5.Accordingly, the petitioner is directed to submit the No Objection Certificate to the third respondent and pay the required service connection charges within a period of two weeks from the date of receipt of a copy of this order. On such payment, the third respondent is directed to provide electricity service connection within a period of two weeks thereafter.

6.The Writ Petition is disposed of with the above direction. No costs.
