This Criminal Original Petition has been filed seeking direction to direct the respondents 1 and 2 to provide police protection to life and limb of the petitioner from the respondents 3 and 4. 2.The learned counsel for the petitioner submitted that the petitioner is the owner of the property in Survey No.155/11 in patta No.578 and land in Survey Nos.155/12, 155/12, 155/15, 157/5- in patta No.564 situated at Manjampatti. The petitioner has growing Teak Trees worth about Rs.10,00,000/- (Rupees Ten Lakhs only) and Coconut Trees Worth about Rs.75,000/-(Rupees Seventy Five Thousand only). The respondents 3 and 4, trespassed into the petitioner's garden and cut the said trees and stolen that. After knowing this, on 21.04.2022, at about 11.00 a.m.
, the petitioner asked the respondents 3 and 4 about the said incident, at that time, the respondents 3 and 4 abused the petitioner in filthy language and made criminal intimidation to the petitioner. In respect of this incident, the petitioner on 03.06.2022 lodged a complaint before the second respondent. As on date, the second respondent has not taken any effective steps to register the complaint. Hence, the present petition has been filed before this Court.
3.The learned Government Advocate (criminal side) appearing for the respondent police would submit that the respondent has received the complaint from the petitioner and the same is pending for consideration.
4. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) appearing for the respondents police.
5.On perusal of records, it shows that the respondents 3 and 4 were trespassed into the petitioner's garden and cut the Teak Trees and Coconut trees, for which, the petitioner has made a complaint before the second respondent police, but, the second respondent police has not taken any steps to register the case as against them.
6.Considering the facts and the circumstance of this case, this Court is directed the second respondent to consider the petitioner's complaint dated 03.06.2022 and if any offence is made out, the second respondent shall register the case and take further legal action in this matter as early as possible.
