PRAYER :- For Anticipatory Bail in Crime No.185 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 380, 421, 463, 209, 211, 506(2) and 294(b) of IPC in Crime No.185 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused persons, in collusion, went to the de-facto complainant's house, stole cheque leaves belonging to his company, namely A1-Ganis Export and Imports, abused him, and also threatened him with dire consequences through WhatsApp voice messages. Hence, a case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person, and has not committed any offence as alleged by 2/4

the prosecution. A false case has been foisted against the petitioner. He, however, submitted that the petitioner is willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Criminal Side) submits that the petitioner has been arrayed as A2 in this case. A1 is still absconding. There are 3 previous cases registered against the petitioner. He submitted that A1 is a relative of the de-facto complainant, and A2 is the son of the de-facto complainant. He further submitted that this Court, on an earlier occasion, specifically directed the petitioner to appear before the respondent police and co-operate with the investigation, but the petitioner failed to comply with the same. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

Taking into consideration of the facts and circumstances of the case, the nature and gravity of the offence, and also taking note of the fact that there are three previous cases registered against the petitioner, and that the 1st accused is still absconding, and that the petitioner failed to appear before the respondent police to co-operate with the investigation despite specific directions from this Court, this Court is not inclined to grant anticipatory bail to the petitioner at this stage. 3/4
