The petitioner has approached this Court seeking issuance of a Writ of Mandamus directing the third respondent to issue a legal heirship certificate in respect of the petitioner's deceased sister, namely, Jothi, by considering his representation dated 01.04.2025.
2. Heard Mr. D. Packiaraj, learned counsel for the petitioner, and Mr. D. Sadiq Raja, learned Additional Government Pleader, appearing for the respondents.
3. The petitioner claims to be the brother of the deceased Jothi, who died issueless on 04.06.2023. Her husband had predeceased her. According to the petitioner, except him, there is no other legal heir surviving the deceased Jothi. The grievance of the petitioner is that the third respondent has not considered his representation dated 01.04.2025 seeking issuance of a legal heirship certificate. 2/5
4. Mr. D. Sadiq Raja, learned Additional Government Pleader, who accepts notice on behalf of the respondents, upon instructions, submitted that the petitioner's representation dated 01.04.2025 would be considered on merits within the time frame to be fixed by this Court. The said submission is taken on record.
5. In view of the above, this Writ Petition stands disposed of with a direction to the third respondent to consider the petitioner's representation dated 01.04.2025 on its own merits and pass appropriate orders in accordance with law.
6. The aforesaid exercise shall be completed within a period of six
(6) weeks from the date of receipt of a copy of this order.
7. There shall be no order as to costs.
