Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the fifth respondent to exhume the buried dead body of the petitioner's son Murugan from the Konnaiyampatti graveyard situated at Iddaiyathur Post, Ponnamaravathy Taluk, Pudukottai District and conduct autopsy and forensic examination to find out the actual cause of death of his son and conduct investigation, by considering his representation, dated 10.04.2024. The petitioner has filed this writ petition seeking direction to the fifth respondent to exhume the buried dead body of the petitioner's son Murugan from the Konnaiyampatti graveyard situated at Iddaiyathur Post, Ponnamaravathy Taluk, Pudukottai District and conduct autopsy and forensic examination to find out the actual cause of death of his son and 2/6
conduct investigation, by considering his representation, dated 10.04.2024.
2. Heard Mr.K.C.Maniyarasu, learned counsel appearing for the petitioner, Mr.RMS.Sethuraman, learned Additional Public Prosecutor appearing for the respondents 1 to 4 and Mr.D.Gandhiraj, learned Special Government Pleader appearing for the fifth respondent.
3. The learned counsel appearing for the petitioner submitted that the petitioner has given a complaint to the respondents on 10.04.2024. But the case has not been registered so far.
4. The learned Special Government Pleader appearing for the fifth respondent submitted that the complaint given by the petitioner has been registered under Section 174 of Cr.P.C. in Crime No.65 of 2024 on the file of Karaiyur Police Station, Pudukottai District. 3/6
5. In view of the above said fact, nothing survives in this writ petition for further adjudication. Hence, this Writ Petition is disposed of. No costs.
