O R D E R

The defendants 19 and 20 in O.S.No.274 of 2010, on the file of the District Munsif Court, Sivagangai, have filed the present Civil Revision Petition seeking expeditious disposal of A.S.No.103 of 2018, pending on the file of the Sub Court, Sivagangai.

2. According to the learned counsel appearing for the revision petitioners, the suit has been field for the relief of partition and the suit is 7/10

decreed as prayed for. Challenging the same, the defendants 19 and 20 alone have filed the above said first appeal. The other defendants have not chosen to file an appeal. The arguments in the appeal were heard, but later it was suo motu reopened on the ground that some of the respondents in the appeal have passed away.

3. According to the learned counsel appearing for the revision petitioners, the defendants who have not challenged the decree, are not necessary parties to the first appeal. Therefore, passing away of those respondents would not in any way be a legal impediment for hearing the first appeal on merits. He further submits that the appellants have filed a memo to the effect that the legal heirs need not be impleaded. He further submits that in case, if the appeal is allowed it will enure to the benefit of the other respondents also, who have not challenged the decree.

4. In view of the above said facts, the learned Subordinate Judge, Sivagangai is directed to dispose of A.S.No.103 of 2018 on or before 31.10.2025.
