ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 I.P.C and subsequently altered into Sections 379, 120b, 420, 465, 468, 471 I.P.C and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.417 of 2021, seeks anticipatory bail.

2.The learned counsel for the petitioner seeks permission of this Court to withdraw this application stating that the crime number has been wrongly mentioned as Crime No.417 of 2021 instead of Crime No.417 of 2020.

3.The learned Government Advocate (Crl.side) appearing for the respondent police has opposed to grant of anticipatory bail to the petitioner that several groups have involved in this crime and valuable minerals have been transported from Tamil Nadu to the State https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.9673 of 2021 of Kerala with the help of some officials. The Hon'ble Division Bench of this Court has also taken serious view on this issue and also transferred the investigation to the CBCID Police. According to the learned Government Advocate (Crl.side), this petitioner is the main accused who was not apprehended so far.

4.In view of the submission made by the learned Government Advocate (Crl.side), this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
