Prayer : This Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent No.2 to dispose of the appeal preferred by the petitioner dated 01.04.2014 within the time stipulated by this Court.

For Petitioner :

Mr.G.Karthik For Respondents :

Mr.M.Siddarthan - for R1 to R4 Additional Government Pleader

ORDER

Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents. Carefully perused the materials available on record.

2. This writ petition is filed seeking a direction to the second respondent to dispose of the appeal preferred by the petitioner on 01.04.2014, within the time frame. On perusal of records it appears that as per the judgment dated 17.06.2021, in W.A(MD)No.1147 of 2021, a Division Bench of this Court directed the Regional Joint Director of School Education to dispose of the statutory appeal filed by the petitioner on 01.04.2014 after giving opportunity to the petitioner and pass orders in accordance with law within a period of three weeks from the date of receipt 2 / 5

of the representation from the appellant in terms of the said direction. Now the present writ petition is filed seeking direction to the second respondent / Regional Joint Director of School Education, to dispose of the appeal preferred by him on 01.04.2014.

3. Admittedly, the petitioner did not take any steps against the appellate authority for not obeying the directions of the Division Bench of this Court in W.A(MD)No.1147 of 2021 dated 17.06.2021. After four years, he approached this Court seeking to dispose of the appeal. In the opinion of this Court, intervention of this Court is not required at this stage and passing any orders also unnecessary, in the light of the judgment of the Division Bench dated 17.06.2021 in W.A(MD)No.1147 of 2021, wherein already a direction was issued to dispose of the appeal by the appellate authority.

4. In view of the same, this writ petition is dismissed.

5. There shall be no order as to costs.
