PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the respondents 1 to 3 herein to give necessary Police protection to the petitioner and her family members for their life and limb based on the petitioner's complaint dated 06.06.2022.

ORDER

This Criminal Original Petition has been filed to direct the respondents 1 to 3 herein to give necessary Police protection to the petitioner and her family members for their life and limb based on the petitioner's complaint dated 06.06.2022.

2. The learned counsel for the petitioner submitted that 1/3

there is a dispute between the petitioner and respondents 4 to 7 regarding pathway. The sixth respondent disputed the path way and the sixth respondent also filed a suit in O.S.No.86 of 2019 pending on the file of the District Munsif Court, Vedasandur. With regard to dispute over the path way, the petitioner seeks Police protection and gave a representation to the respondent Police protection.

3. The learned Government Advocate (Criminal Side) submitted that there is a dispute with regard to cart track porombokku in Survey No.574/4. With regard to encroachment, there is a dispute between the two parties and there was a law and order problem. Hence the Inspector of Police requested the Tahsildar, Gujiliyamparai to consider the patta with regard to Survey No.574/4 and also requested to take action with this land dispute to avoid the law and order problem.

4. I have considered the matter in the light of the submissions made by the learned counsels for both the parties.

Admittedly, there is a dispute between the petitioner and the respondents 4 to 7 with regard to cart track and a suit in O.S.No.86 of 2019 was filed and is pending before the District Munsif Court and the Inspector of Police also sent a letter to the Tahsildar to decide the patta with regard to cart track poromboku in Survey No.574/4 and avoid law and order problem. Under these circumstances, the third respondent Police is hereby directed to consider the representation of the petitioner dated 06.06.2022 and to take suitable action in this matter.

6. In view of the above, this Court directs the third respondent Police to consider the representation dated 06.06.2022 given by the petitioner and take appropriate action in the matter.

7. With the above direction, this Criminal Original Petition is disposed of.
