For Respondent : Mr.M.MUTHUMANIKKAM, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- Anticipatory Bail in Crime No.505 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(a) and 4(1)(A) of the Transport Prohibition Act in Crime No.505 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 03.07.2021 at about 11.00 a.m., the petitioner was found in illegal possession of 129 TASMAC liquor bottles each containing 180ml near Kalpalayam North Street Police Station. Therefore, this case came to be registered. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. CRL OP(MD). No.9670 of 2021 4.The learned Government Advocate (Crl. Side) for the respondent opposed this petition on the ground that investigation in this case is not completed and the petitioner is having three previous cases pending against him, out of which, one case is similar nature.

5.Considering the facts and circumstances of the case and the fact that the petitioner is having three previous cases pending against him, out of which, one case is similar nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 27/07/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
