[Order of the Court was made by R.MAHADEVAN, J.] The prayer in this writ petition is for issuance of a writ of mandamus directing the respondents 1 to 5 to remove the encroachments made by the respondents 6 to 9 in the common pathway situated in S.F.No.
612/17, to an extent of 0.07.50 Ares, in Kuttathupatti Village, Dindigul West Taluk, based on the petitioner's representation dated 01.04.2019.
2. The grievance of the petitioner is that though he made a representation to the respondents 1 to 5 as early as on 01.04.2019 seeking removal of the encroachments made by the respondents 6 to 9 in the aforesaid survey number, till date, the same has not been considered.
3. The learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, submitted that the authorities concerned have already conducted a survey in the subject area, found out the encroachments as alleged by the petitioner and the same would be removed in the manner known to law.
4. In view of the above submissions, the authority concerned is directed to remove the encroachments made by the respondents 6 to 9 in the subject area, after giving due notice and sufficient opportunity to all the parties concerned and by following due process of law, within a period of eight
(8) weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
