Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C. to direct the learned Judicial Magistrate No.II, Virudhunagar to expedite the trial in C.C.No.17 of 2010 pending before the learned Judicial Magistrate No.II, Virudhunagar and complete the same within a stipulated period prescribed by this Honourable Court.

ORDER

This direction petition has been filed by one of the witnesses who was instrumental in setting the law in motion along with the officials of Hindu Religious and Charitable and Endowments Department. The petitioner has filed this petition for a direction to the learned Judicial Magistrate No.II, Virudhunagar to expedite the trial in CC. No.17 of 2010.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

3. It is seen from the records that originally there were two accused persons and during the pendency of the case, A1 died and A2 is the sole accused who is facing trial. His presence is also dispensed with by virtue of the order passed by this Court. It is also seen from the records that the case was adjourned from time to time by the court below waiting for original registers which were received by the CBCID, Viruthunagar only on 04.05.2017. Even thereafter the case is being adjourned from time to time. https://hcservices.ecourts.gov.in/hcservices/

4. Taking into consideration the fact that the C.C is of the year 2010, this Court directs the learned Judicial Magistrate No.II, Viruthunagar to expedite the trial in C.C. No. 17 of 2010 and complete the proceedings as early as possible and not later than six months from the date of receipt of copy of this order.

5. With the above directions, the Criminal Original Petition is disposed of.
