The above petition has been filed seeking orders to condone the delay of 80 days in filing the appeal, challenging the judgment and decree made in A.S.No.56 of 2023 on the file of the learned Additional Subordinate Judge, Kumbakonam, confirming the judgment and decree made in O.S.No.138 of 2013, dated 16.08.2023 on the file of the Principal District Munsif Court, Kumbakonam, 2.Heard the learned counsel for the petitioner, learned counsel for the first respondent and also perused the records.

3.The learned counsel appearing for the first respondent would submit that they are not having any objections to allow this petition. 4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order and list the matter in the usual course.
