Challenging the order passed by the learned Single Judge in W.P.(MD)Nos.25242 and 25564 of 2025, dated 18.11.2025, the respondents therein have preferred the present Writ Appeals.
2.It is brought to the notice of this Court by the learned counsel appearing for the respondent/writ petitioners that, as against the common order dated 29.08.2025 passed in W.P.(MD) No.18378 2/6
of 2025 and connected cases, a batch of writ appeals came to be filed in W.A.(MD) No.2748 of 2025 etc., batch. The Division Bench, by a common judgment dated 09.01.2026, set aside the orders relating to both re-fixation of pay and recovery. The relevant portion of the judgment reads as follows:
"25. As per the above ratio, the proceedings dated 24.08.2016, which are the root cause for all the litigations, became ipso facto not binding on the petitioners and are illegal. Therefore, this Court is of the firm view that any teacher who acquires a higher qualification in subjects forming part of the Higher Secondary syllabus is entitled to incentive increments as stipulated in G.O.Ms.No.324, dated 25.04.1995. It is also relevant to note that these teachers have been receiving the incentive increments for more than a decade. 26.Accordingly, in view of the above detailed discussion, the impugned orders relating to re-fixation of pay and recovery are set aside. ..."
3.Admittedly, the respondent/writ petitioners herein stand on 3/6
the same footing as the writ petitioners in the aforesaid batch of cases and is, therefore, entitled to the very same relief. The learned Single Judge has rightly allowed the Writ Petitions by following the binding judgment of the Division Bench. We find no merit in the present Writ Appeals.
