Prayer : This Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the contemnors/respondents for their willful disobedience of not following the order of this Court dated 23.04.2024 in W.P.(MD)No.9883 of 2024.

O R D E R

This Contempt Petition has been filed alleging disobedience of the order of this Court dated 23.04.2024 in W.P(MD)No.9883 of 2024. 1/4

2.The grievance of the petitioner is that though the petitioner was permitted to participate in the certificate verification by orders of this Court dated 23.04.2024, the petitioner was not called upon for certificate verification.

3.The learned counsel for the respondents submitted that the petitioner has not reached the zone of consideration for physical certificate verification and counselling in the ratio of 1:3/1:1.5 for the posts included in Combined Civil Services Examination-II (Non interview Posts) (Group II A Services), even though she was considered under PSTM category, in view of the fact that the cut of marks for B.C. (Women) (PSTM) category is 128. Unless the petitioner comes under the zone of consideration, it cannot be claimed that she had been omitted to be called for certificate verification.

4.From the information furnished by the respondents vide memorandum dated 09.05.2024 in Memorandum No.271/PSD-A2/2022, it is seen that the cut of marks for the Combined Civil Services Examination-II (Non interview Posts) (Group II A Services) (PSTM category) is 128.

5.In the order dated 23.04.2024, it has been observed that the respondent shall not deprive the petitioner from participating in the certificate verification on par with the similarly eligible candidates. The petitioner has not reached the eligible level that is zone of consideration then, the petitioner cannot expect the respondents to call her for certificate verification.

6.The respondents had issued a letter dated 11.07.2024 in C.No.271/PSD-A2/2024 regarding what had happened in the first phase of counseling. It is further submitted that in the second phase of counseling, the cut marks will be reduced. If the cut of marks is reduced in the second phase of counseling, it may be fair on the part of the respondent to call the petitioner for certificate verification, if she reaches the zone of the consideration.

7.With the above observations, this contempt petition is closed.
