PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the third respondent not to interfere into civil dispute and thereby not to harass the petitioner and her family members under the guise of enquiry.

ORDER

This petition is filed to direct the third respondent not to interfere into civil dispute and thereby not to harass the petitioner and her family members under the guise of enquiry, based on the representation made by the petitioner, dated 12.07.2021. 2.The case of the petitioner is that in respect of the property situated in Survey No.460/3 to an extent of 1 1⁄2 cents in Chellappanaickanpalayam, Natham Taluk, Dindigul District, suit has been filed by the petitioner in O.S.No.22 of 2017 against the fourth respondent seeking injunction, before the District Munsif cum Judicial Magistrate Court, Natham and during the pendency of the suit, the fourth respondent gave complaint before the third respondent and on the basis of the said complaint, the third respondent is pressurizing the petitioner to vacate the above said land by making harassment.

3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor(Crl.side) for the respondents 1 & 2.

Crl.O.P(MD).No.9697 of 2021 4.The learned Additional Public Prosecutor would submit that no complaint has been received from the fourth respondent by the third respondent. Since no complaint has been received, there is no question of harassment.

5.Recording the submission of the learned Additional Public Prosecutor that no complaint has been received by the respondent police, this Criminal Original Petition is disposed of with a liberty to the petitioner to approach the appropriate civil Forum, if any trouble arises in future.
