Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorari, calling for the records pertaining to the proceedings in R.C.No. LC/PRO/19375/2012 dated 22.02.2013 on the file of the first respondent herein, quash the same.

J U D G M E N T

[Judgment of the Court was delivered by T.RAJA,J.] This writ appeal has been directed against the order passed by this Court in W.P.(MD).No.3803 of 2013, dated 26.02.2018.

2. Mr.Veera Kathiravan, learned Senior counsel appearing for the appellant fairly submitted that as the appellant is going to retire shortly on reaching the age of superannuation on 31.03.2019, he is not prepared to contest against the issuance of impugned charge memo. He further submitted that since he is prepared to take part in the proceedings, the respondent may be directed to complete the disciplinary proceedings.

3. Since the petitioner is reaching the age of superannuation on 31.03.2019, the learned Special Government Pleader sought eight weeks time to complete the enquiry.

4. The petitioner is directed to co-operate with the enquiry and the disciplinary authority shall ensure the completion of the enquiry including passing of the final order within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, the writ appeal stands disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
