Writ Petition filed under Article 226 of the Constitution of India, praying this Court To issue a WRIT OF MANDAMUS, or any other appropriate writ or direction in the nature of a writ directing the Respondents to consider the claim of the petitioner for promotion as Asst. Director of Local Fund Audit for the year 2009-2010 without reference to the punishment imposed on the petitioner in GO [2D] No.26 Finance (Local Fund) Department dated 17-03-2008 and promote him as Asst. Director, Local Fund Audit and grant him all consequential service and monetary benefits. JUDGMENT

(Judgment of this Court was delivered by S.MANIKUMAR, J.) Vide order dated 24.03.2010, in W.P.(MD)No.3886 of 2010, the writ petitioner has been directed to be included in the panel of Assistant Director in Local Audit Fund Department for the year 2009-2010, if there was no other legal impediment. The said exercise has to be done within a period of four weeks from the date of receipt of a copy of the order made in the writ petition. 2.On this day, when the matter came up for hearing, on instructions, Mr.AK.Bhaskarapandian, learned Special Government Pleader submitted that subsequently, the writ petitioner has been promoted as Assistant Director and later on he has also retired from service.

3.In view of the above, nothing survives in this writ appeal for further adjudication. Hence, the writ appeal is dismissed. No costs. Consequently, connected CMP is also dismissed.
