FOR ANTICIPATORY BAIL IN CRIME NO.143 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 286, 337 and 304(2) IPC r/w Section 9(B)(1)(b) of the Indian Explosive Substances Act in Crime No.143 of 2024, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is running a crackers shop and when tin roof was being erected, a spark exploded and accident occurred. In the said accident, the brother of the petitioner died and one person got injuries. Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the accident was occurred, due to electrical short-circuit and it was not occurred because of the crackers.

4.The learned Government Advocate(Crl.side) appearing for the respondent Police would submit that due to the accident, one person died and one person got severe injuries and he is still in hospital as in-patient. Therefore, he strongly opposed to grant anticipatory bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the fact that the injured person is still in hospital, this matter is adjourned to the second week of the June, 2024.
