judicial custody on 21.03.2025 for the offences punishable under Sections 8(C) r/w 20(b)(ii)(C) of NDPA Act, in Crime No.652 of 2023 on the file of the respondent, seeks bail.

2. The case of the prosecution is that on 29.12.2023 at about 12.15 pm, on the secret information, the respondent police went to near Mekizharpatti Service Road, Usilampatti-Battlagundu Road, and on searching, the accused were found in illegal possession of 36 kg of ganja. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and she was falsely implicated in this case and she has not committed any offence as alleged by the prosecution. He would further submit that this is the third bail petition and the earlier petitions filed by the petitioner were dismissed by this Court and the petitioner is in judicial custody from 21.03.2025 onwards. Therefore, prayed to grant bail for the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent strongly opposed to grant bail to the petitioner on the ground 2/5

that this is the third bail petition and the earlier petitions filed by the petitioner were dismissed by this Court and and there are no change of circumstances and the petitioner has previous cases similar in nature.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and the petitioner also having some previous cases for the similar kind of offences and earlier petitions filed by the petitioner was dismissed by this Court and there are no change of circumstances and the contraband was recovered from the house of the petitioner and thereby, the petitioner failed to comply with the condition under Section 37 of NDPS Act, I am declined to grant bail to the petitioner, at this stage.

7.Accordingly, this Criminal Original Petition stands dismissed. 3/5
