PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.46 of 2024 on the file of the Respondent police. ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 174 Cr.P.C and 1/3

subsequently alter into under Section 306 IPC in Crime No.46 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The learned Government Advocate (Crl.side) submitted that the case is registered only under Section 174 Cr.P.C and till now the same has not been altered.

3. The learned counsel appearing for the petitioner submitted that it has been altered into IPC offences.

4. The police official is present before this Court for instruction, who has confirmed that it has not been altered and it is only under Section 174 Cr.P.C and therefore, anticipatory bail petition is not maintainable.
